By accessing www.deckitout.co.uk or using my services, you accept and agree to be bound by the terms and provision of this agreement. Any participation in my services will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use my services.

ACCURACY WARNING

The images of my services on my website are for illustrative purposes only. Although I have made every effort to display the colours accurately, I cannot guarantee that your computer's display of the colours accurately reflects the actual colour.

I offer handmade services so sizes and dimensions of finished creations may vary from those indicated on my website.


INTELLECTUAL PROPERTY

My website and its original content, (including logos, graphics and images) are owned by DECK and are protected by the appropriate trademark and intellectual property laws.


LINKS TO OTHER WEBSITES

My website contains a number of links to other websites and online resources that are not owned or controlled by DECK.

I have no control over, and therefore cannot assume responsibility for, the content or general practices of any of these third party websites and/or services. Therefore, I strongly advise you to read the entire terms and conditions and privacy policy of any website that you visit as a result of following a link that is posted on my website. 


MY SERVICES

You may make an enquiry about my services via the enquiry form on my website. You may also enquire by email, phone or social media. After you make an enquiry, you will receive acknowledgement that I have received your enquiry via email, phone or social media. This will be followed by a discussion of suitable services and associated quotes for you to consider.  However, please note that this does not mean that your booking has been accepted.

Available services include:

Our discussion phase allows you to check and amend any errors before committing to a booking. Please take time to raise any questions or concerns during this stage.

Once a service and quote is agreed, I will ask you to complete an online customer booking form requesting information necessary to complete your invoice. An email will be sent to you attaching the invoice - this is your order confirmation. The contract between us will only be formed when I send you the order confirmation.   


ALTERATIONS/CANCELLATIONS

If you require changes to be made to your service after the order confirmation has been sent please email info@deckitout.co.uk. I reserve the right to make a reasonable alteration to the quoted price. I will notify you of any such alterations upon receipt of your notification. Alterations requests made less than 14 days before the set-up/delivery/collection date may be refused if I am unable to source new materials to meet your request.

If a change of my circumstances means that I am unable to fulfil your service, I will inform you of this by email as soon as possible and cancel your booking. If you have already paid for the service, I will refund you the full amount as soon as possible.

All services shown on my site are subject to availability of materials. I will inform you by email as soon as possible if the service you have requested is not available due to a shortage of materials. This may result in the cancelling of your booking although I will endeavour to suggest alternatives where possible.

If you wish to cancel your booking, you are entitled to do so for any reason. Please contact me and I will arrange a full refund. Cancellation requests made less than 72 hours before your set-up/delivery/collection date can not be accepted because balloons (classed as perishable goods) may already be inflated in preparation for your booking.

Your right to cancel a contract starts from the date of the order confirmation, which is when the contract between us is formed, and will last until 3 calendar days prior to your set-up/delivery/collection date.


PAYMENT POLICY

Payment is required in full upon receipt of your order confirmation unless there is more than 14 days until your set-up/delivery/collection date. If bookings are made in advance, payment must be received at least 14 days prior to your set-up/delivery/collection date. Please note that a set-up date can be up to several days before an event if access times at venues require it.

Preferred payment method is via bank transfer. My bank details are displayed on your invoice.

If payment is not received as per the above guidance, you will forfeit your booking.


DELIVERY AND SET-UP

For a balloon installation, your order is fulfilled once set-up is completed at the designated venue.

For a balloon creation for collection, your order is fulfilled when the creation is collected from my Norwich studio.

For a balloon creation for delivery, your order is fulfilled when the delivery has been received at the address you gave me. Delivery is made personally by DECK so the service is only available in Norwich and surrounding areas. Delivery will be paid for by the buyer of the amount agreed upon by the seller at the time of purchase.

The installation will be your responsibility once the order has been fulfilled. Unless a de-rig of the installation is booked with us, the de-rig and disposal of the materials is your responsibility. 


BALLOON CARE

Balloons burst! The most obvious precaution you must take is to keep your balloons away from sharp objects and rough surfaces. 

The installation/creation will be your responsibility from the completion of set-up/delivery/collection.  Dispose of balloons correctly. When you are finished with a balloon, snip the end of the balloon with scissors or pop it with a pin and put the biodegradable latex waste in the bin with general waste. Read my Environmental Stance for more information.

Balloons can be dangerous, particularly for young children. Children can choke or suffocate on uninflated or broken balloons; adults should always supervise young children—especially those under eight years old—with balloons. It is your responsibility to take appropriate safety measures for the placing, use and disposal of any balloons.

Latex balloons are made of natural rubber latex and are biodegradable, but may cause allergic reactions in people who are allergic to natural rubber latex. If guests at your event are vulnerable, it is your responsibility to make sure they are aware.

When ordering services for use outside, consideration should be given to the effect adverse weather conditions can have on the balloons and other materials. Balloons outside will degrade most quickly. Exposure to wind, moisture, heat and direct sunlight causes the latex to weaken and makes it susceptible to bursting. Therefore, I only recommend exterior and outdoor installations for a one-day event.

I advise that you consider, and have available, an alternative plan in the event of poor weather conditions.

If, after order fulfilment, adverse weather affects the balloons, I am not responsible, although I will ensure that all materials are secured and weighted appropriately during set-up.

By agreeing to these Terms, you confirm that you have understood this warning and agree to use and dispose of the balloons with care and safety.  


REFUND/EXCHANGE/CREDIT

Balloons are fragile by nature, so even though every precaution is taken to keep them safe, they are at risk from bursting and deflating. This is a characteristic and not a fault.

All my creations are handmade and inspected before delivery/installation. If you discover any elements that you believe to be faulty or mis-described you must photograph those particular elements and email them to info@deckitout.co.uk with a description as soon as reasonably practicable.

If an element is deemed faulty or mis-described I will send out a replacement where possible, otherwise I will offer a full/partial refund or credit depending on the overall impact on the installation.

Refunds will be issued via bank transfer.


EVENTS OUTSIDE MY CONTROL

I will not be liable or responsible for any failure to perform, or delay in performance of, any of my obligations under a contract that is caused by an event outside my control. 

An "event outside my control" means any act or event beyond my reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

If an event outside my control takes place that affects the performance of my obligations under our contract:

I will contact you as soon as is reasonably possible to notify you and arrange a new booking date/time after the event outside of my control is over.


NOTIFICATION OF CHANGES

I reserve the right to modify these Terms & Conditions at any time. I do so by posting and drawing attention to the updated terms on my site. Your decision to continue to visit and make use of my site after such changes have been made constitutes your formal acceptance of the new Terms & Conditions.

Therefore, I ask that you check and review this agreement for such changes on an occasional basis. Should you not agree to any provision of this agreement or any changes I make to this agreement, I ask you to not use or continue to access www.deckitout.co.uk or use my services immediately.
